             In 1997 the Green Paper who decides' customised the laws relating to mental incapacity, giving social workers the power to intervene to protect the elderly and those vulnerable or incapable of making their own decisions. .
             In March 2000 at the Action on Elder Abuse's conference the Department of Health launched No Secrets'. This was guidance on developing and implementing multi-agency policy and procedures to protect vulnerable adults from abuse (DOH 2000). Written in the forward of this policy is the statement "There can be no secrets and no hiding place when it comes to exposing the abuse of vulnerable adults. (Clarke, Denham & Hutton 2000).
             When the no secrets' policy guidance (under section 7 of the Local Authority social Services Act 1970) for protecting vulnerable adults was implemented, no funding from the government was made available for its launch. Jacki Pritchard co-ordinator of the Practitioner Alliance against Abuse of Vulnerable Adults (PAVA) was refused section 64 government funding on two consecutive years. Section 64 government funding is designed to support groups which help to promote the DOH policy objectives. (Communitycare website).
             Before examining no secrets' policy guidance, I want to study what legislation if any is in place for the protection of vulnerable adults. At present social workers/care managers have no significant power to intervene and have little backup from our legal system in Britain. The major power of the law in this area come from the police, but this is without its own problems as they are usually reluctant to get involved, this is usually from lack of co-operation to produce evidence to prosecute as the service user is usually unwilling to get involved. The unwritten rule is that generally vulnerable adults do not make good witnesses and usually their mental capacity is not stable enough to prosecute.
