Consumer Product Safety Commission


These laws are (1) the Consumer Product Safety Act, which among other things, contains certain reporting requirements; (2) the Federal Hazardous Substances Act which applies to hazardous household substances and children's products; (3) the Flammable Fabrics Act which applies to products such as clothing, mattresses and carpets; (4) the Poison Prevention Packaging Act which requires child-resistant packaging for certain drugs and other hazardous household substances such as furniture polish; and (5) the Refrigerator Safety Act which requires household refrigerators to be easy to open from the inside
             Each of these statutes provides sanctions for violations. These include both civil and criminal penalties against the responsible firm or individual.
             (Consumer Reporting).
             Since the CPSC has been established for consumer protection, consumers should take an active role in supporting that mission. In the event that a consumer has a question concerning the safety of a product, they may contact they CPSC, via email, phone, fax or letter. The CPSC, upon receipt of the notification, will send a letter, to the consumer, from CPSC's National Injury Information Clearinghouse. It will describe how the CPSC will use the information and ask the consumer to review the report to confirm its accuracy. If the consumer has identified a manufacturer in the complaint, the CPSC will send the complaint to the manufacturer. In some cases, a direct response from the manufacturer may be provided to the consumer. The CPSC may or may not investigate the product complaint, due to the approximately 10,000 reports of product-related injuries and deaths from consumers and others. In the event that the CPSC does deem an investigation necessary, the consumer will be contacted by a CPSC investigator. If, based on the investigation, they decide to recall the product or take other action, that information would be made public via a news release.
