The paralegal shall be competent in the form of education, training, and work experience and also participate in a minmum of 12 hours of continuing legal education which 1 hour must be for ethics education every two years to remain curent on developments in the law, just like other professions. He or she shall perform all work assignments quickly and efficiently. .
A paralegal shall not engage in any ex-parte communications involving the courts, adjudicating body (e.g. Appelas Boards) in attempt to exert undue influence or to obtain advantage or any benefits of only one party. Shall not communicate with a party that the paralegal knows to be represented by a attorney in a pending matter without the prior consent of the attorney. .
He or she shall ensure an accurate, honest, and complete timekeeping and billing records and not to engage in fraudulent billing practices(e.g. inflated hours billed to a client or employer) or misrepresent the nature of his or her performed or fraudulent submission of expense and disbursement documentation.
A paralegal shall notify the proper authorities of any non confidential knowledge of any dishonest or fraudulent act (s) that is in direct violation of the Model Code / Model Rules and/or laws governing the jurisdiction in which the paralegal practices not limited to by any person pertaining to the mishandling of funds, securities or other assests of a client (customer).
The report to authority or authorities shall depend on the nature and cicumstances of the misconduct (e.g. local prosecutor, local or state bar associations, local or state police, etc.). The failure to report such knowledge is in itself miscondect and shall be treated as such under these rules.
A paralegal shall be honest in the identification and maintenance of all funds, securities and other assests of a client and hold an accurate accounting as appropiate. .
