It has been stated that pornography creates disastrous effects to our society. There have also been claims that pornography depersonalizes and causes problems in marriages and relationships. There is no such evidence to support those claims and therefore I believe it to be unjust to censor pornography. .
Pornography is not specifically mentioned in the Constitution, but it is a controversial subject of political debate in this country. To some, pornography is evil and destroys many individuals and their families and is viewed as immoral material. To others, pornography is a means of growth and self-expression, is most arousing and enjoyable, and is protected by the Constitution. .
The word pornography derives from a Greek word meaning writing about prostitutes. Although there is no widely accepted modern definition, the common factor in all definitions is that the material is sexually explicit. Pornography is just a term to single out some category, but the real issue is whether the explicit description or depiction of sex should ever be illegal. Obscenity may be prosecuted, indecency may be regulated but not banned, and ordinary speech must be left alone entirely, even though it is sexually explicit. .
It is clearly recognized that pornography cannot be obscene, although it may be indecent. Under today's law much explicit sexual depiction and speech is not considered as being obscene and is therefore protected. Thus, censoring pornography would be in violation of rights under the First Amendment. .
The most important pro-censorship argument is based on the harm principle. Some people argue that the law is within its rights to restrict actions by one individual that harms another. They often hold that exposure to pornography is a direct cause of sex related crimes such as rape. They also believe that pornography promotes sexist attitudes against women. However, there is no evidence to support the claim that pornography is a direct cause of sex related crimes.
