This program is for first-time, non-violent drug offenders who:.
• Have been placed on probation by the Drug Court. .
• Have pled guilty to or been found guilty of a drug crime.
• Have had their controlled substance abuse deemed a precipitating or contributing factor in the commission of their crime.
• Have no history of violent behavior in the community.
• Have sentences 4 to 10 years in length.
In a recent interview, David Oldfield, Director of Planning and Research, provided a list of violent offenses:.
• 1st-degree Arson.
• 1st- and 2nd-degree Murder.
• 1st-degree robbery.
• Kidnapping.
• 1st-degree Assault.
• Forcible Rape.
• Forcible Sodomy (personal communication, June 16, 2003).
To prevent first-time, non-violent offenders from being incarcerated and possibly defecting to a life of crime, the Court System reserves the right to order them to attend a community-based inpatient treatment program sponsored by the Offenders Under Treatment Program. Once ordered to this program, the offenders receive their start date and attend an intensive 12-week program designed to rehabilitate them while also treating their addictions (Missouri Department of Corrections, 2003).
If the offenders complete the program successfully, they complete their probation as required by the Court System and avoid being incarcerated or sent to the institutional phase of the program (Phase II). Conversely, the Court System reserves the right to remand to the Sentencing Court any offenders who fail to complete this program successfully. Once the Court System has remanded the offenders, the Sentencing Court may require them to participate in the institutional phase of the program (Phase II). .
Post Conviction Drug Program (Phase II).
The criteria for the Post Conviction Drug Program (Phase II) are similar to the criteria for the Offenders Under Treatment Program (Phase I).
