Most of the fault lies in the Fund's reliance on victim's income (at time of death or injury) to determine settlement. In the following paper, I propose to explain some of the ways this particular policy, results in unfair and unequal monetary awards to some and not others. Its important to note that a disproportionate number of those earning lower wages were in service jobs such as hotel employees and food service workers (for instance, Windows on the World Restaurant in Tower 1) many of whom were immigrants and of races other than white. I also discuss the problems associated with initial entrance into the Fund's program and how it adversely affects those most in need (low-income wage earners). I devoted a portion of this discussion to certain payments (specifically unpaid services) handled under the guise of Economic Loss that are either not addressed or underpaid to those who deserve it most (women). There were many other problems as well (not discussed here) such as how eligibility to participate in the program was determined specifically for gays, lesbians and others who considered themselves "domestic partners" of the decedents but who were not considered legitimate beneficiaries by the Fund. Due to time and space constraints, I devoted most of my paper to the inequalities which resulted in the methods used to determine compensation, most of which adversely affected women and low-income wage earners (which are made up of a disproportionate number of non-white, minority individuals of lower social classes or lower S.E.S.).
             Participation in the 9-11 Fund.
             Under the new and final Rule of Compensation compensatory damages would be paid to the family or personal representative of an individual killed (or to any individual injured) as a result of the 9-11 tragedy. Beneficiaries would be paid for economic1 and non-economic2 losses. The awards for non-economic losses in the Interim Final Rule set an amount of $250,000 plus an additional $100,000 for the spouse and each dependent.
