            French writer Alexis De Tocqueville wrote: "There are only two ways to establish a policy of equality: give rights to all, or do not give rights to anybody." When the word homosexual is said most people feel uncomfortable. This is because "gay" and "lesbian" have become obscene words in society. Morality often plays a big part in the discussion of legalizing gay marriage; many people have religious beliefs that say that homosexuality is wrong and unnatural. Some say that gay marriage would ruin the sacredness of marriage, since the church would be allowing something that is against the rules; but what about the separation of church and state? Can sacredness, holiness, and God be intermingled with the Constitution? History shows that people have different beliefs in determining what is right and wrong; however all people are entitled to the same basic rights. Legalizing gay marriage would uphold the Constitution and give all Americans the rights and freedoms that they deserve.
             Many legal documents are being violated in the issue of gay marriage. The Constitution, which is the highest law of the land is being violated in many different ways; the first is the fourteenth amendment. The fourteenth amendment states that all men have equal protection under the law; the denial of marriage is not equal protection or equal rights. According to article nine of the Constitution the enumeration, of certain rights, shall not be construed to deny or disparage others retained by the people. In other words the Constitution cannot be interpreted to deny or belittle the rights upheld by its people. The first amendment is also being violated; for one does not truly have freedom of religion if one does not have the right to freedom from religion as well. The defense of marriage act, or DEMO, was passed in 2001 by the senate. This act states that the federal government will not recognize gay marriages; this enables states to ignore other state's legal documents regarding gay marriage.
