Hate Speech


A speech code must be written in such a way to avoid conflict or doubts about what is appropriate and what is not. Although a speech code will place limits on students, it will not always be regulated and ultimately, the student will say whatever he or she wants to. There is debate that if a speech code is written, it is a violation of the First Amendment to the United States Constitution. Three important issues in discussion are whether hate speech on a college campus can be avoided by those who are offended by it, whether a university is unique and should restrict speech, and the most controversial question, can a speech code be written that doesn't clash with the First Amendment?.
             The most important issue is whether one person's right to free speech is more important than another's right to be free from harassment and discrimination. People who argue for free speech say the constitution is clear in its writing. After all, if there is a display of hate speech, the individual who is offended can just simply walk away and they are not forced to listen to hate speech. After all, if students are to be protected' from bad ideas, how are they going to learn to identify and cope with them? If people were constantly protected from other people who are expressing their opinions, people will not learn diversification, and they should be open to the views of others.
             People who argue for the rights of the minorities' say we're all equal, and no one should have to hear offensive remarks on school grounds because such remarks interfere with learning. Furthermore, they argue that speech codes are unfortunately necessary to achieve protection against those who abuse their rights to free speech. We have codes to protect racism, sexual harassment, civil rights and many more. Free speech should not cause harm to another. Universities or Colleges formulate policies to use when incidents of extreme verbal violence occur.
