Kevin undressed in the office for his daily run. At one point, Kevin would touch her, making Elyse more uncomfortable. Kevin did stop after Elyse told him to keep his hands off of her, this happened after several encounters. Another episode was the Sport USA swimsuit magazine, and Kevin cut out a picture of a swimsuit and put Elyse name across the top and posted the picture on his wall. Elyse complained to their supervisor Fran Troy, on two occasions regarding Kevin's actions, which resulted in little to no change in Kevin's behavior. Kevin constant demeaning conduct, along with the swimsuit picture posted on the wall; Elyse decided to seek counseling to help her deal with this situation. She dreaded going to work and often felt physically ill. On January 23, 1989 Elyse filed a sexual harassment complaint with the Equal Employment Opportunity Commission (EEOC), bypassing her direct chain of command. On March 3, 1989 Elyse request to EEOC for the right to sue, was approved. After EEOC investigation, two major effects resulted from their investigation, Kevin attitude towards her changed to cold indifference, and she was transferred to another office. March 15, 1989 a lawsuit against District of Columbia with claims of sexual harassment and intentional infliction of emotional distress.

Is the District Attorney's Office responsible for Kevin Murphy's actions? The issues are the violations of Title VII. There are four elements when violated present the issue of sexual harassment if they are using the persons employment or future employment decisions based on the violations or if changing the persons work performance. In this case there were several violations that showed to be affecting the employee Elyse Roberts work performance as well as creating a hostile work environment (Melvin, 2011). Elyse had received her first evaluation as "good" and since the situations listed below Elyse's ability to perform was diminishing.
