Men's Reproductive Rights


            The first reason why fathers should have more reproductive rights is because it is unjust for a man to pay child support when he has no say over whether or not to keep the child. Dr. Allan Stewart (Sociologist) and Dr. Trussle (Gyno-anthropologist) "[estimate] that every year 25,000 - 32,000 women in the United States become pregnant as a result of rape. On average 5% of those rapes are female-on-male with 626 children being carried to full term from male rape" (Stewart & Trussell, 2000). For the unfortunate men whose rapist's decide to carry their child to term, the repercussions from their horrific ordeal does not stop after the physical act. Since 1998, 25 female-on-male rape cases that result in pregnancy have been brought before specialty courts. These cases are unique in that the woman has petitioned the court to compel the raped man to provide financial support to the child conceived during rape. One of these proceedings included the case of Hermesmann v. Seyer. In 1993, Colleen Hermesmann a 17-year-old babysitter from Kansas, was brought before the jury on charges of "Statutory rape of a minor" as well as "Attributing to a child's misconduct." Earlier that year, parents of Shane Seyer discovered that the woman they had hired to take care of their 13-year-old son was having intercourse with him and had became pregnant. Because Shane was a minor, he legally could not consent to intercourse and Colleen was charged. Four years later, Ms. Hermesmann , aided by Kansas Department of Social and Rehabilitation Services (KDSRS) , summoned Shane and his family to court. They claimed that Shane, who was now 17, had the legal obligation to pay child support for the infant conceived through unlawful intercourse. Shane's defence attorney argued that because of the nature in which the child was conceived, Mr. Seyer should be relinquished of his duties. The case was then brought before the Kansas Supreme Court, where the judge ruled in favour of the Maternal.
