The EU and the Internal Market


            The internal market has a significant impact when it comes to creating a geographical area made of the member states whereby goods, workers and capitals can circulate freely without restrictions if any. Moreover Articles 34 and 36 TFEU govern the elimination of non-tariff barriers to the free movement of goods1. "It states that quantitative restrictions on imports and all measures having effect shall be prohibited within member states.".
             It is crucial to identify both in article 28 and 303, as the eliminations of any restrictions on the free movement of goods is key to the creation of the internal market in the member states of communities. The court of justice defines 'Goods' in the case of Commission v Italy (1968) as "products which can be valued in money and which are capable, as such, of forming the subject of commercial transactions. On the other hand this leaves a very wide definition in which many items may not be considered as 'goods' for example in the case of R v Thompson, (1978), 4where 'goods' were taken to include gold and silver collectors, coins however not in circulation as legal tender. Although later in the case of Commission v Belgium, (1992) 5the court of justice emphasised what really matters is that the goods are capable of being subject of 'commercial transactions' in other words 'good' that are capable of being sold. The Court of justice disregarded the 'intrinsic monetary value' as less important.
             Article 34, and 35 TFEU6, underlines the prohibition of imports and export and prohibition between member states. Article 34 7which states "quantitative restrictions on imports and all measures having equivalent effect shall be prohibited between member states' whereby article 35 states that "quantitative restrictions on exports, and all measures having equivalent effect, shall be prohibited in the member states.
