DWI


Many individuals bring about DWI bills to the attentions of the legislature each year. Many of those bills fail to obtain the approval needed to start to impose them. Public Safety Secretary Glenn Ellington tried but failed this year to get the legislature to approve a bill that would have change procedure and evidence rules for hearings. He wanted to allow police officers to attend hearing by the internet of phone. A majority of DWI cases that are dismissed in New Mexico are because the arresting officers do not attend the hearing. This kind of legislation is needed to take more DWI offenders of out from behind the wheel. Treatment is expensive but need to curb our ever-growing DWI problem. Another bill that was before our legislature this term was one sponsoring the allocation of more money for alcohol treatment programs. The government wants DWI rates to drop, but are they willing to pay for it? The DWI epidemic is continuing in New Mexico because of the lack for proper legislation to stop it.
             Another of the reasons DWI is such an epidemic in New Mexico is because many offenders fall through the cracks in the system. Last year, Bureau of Indian Affairs employee, Lloyd Larson, was driving on government time when he crashed into two Nebraska couples; both couples were killed in the crash. Larson had a blood-alcohol level of .205 percent more than twice the legal limit. Larson had been arrested seven other times for driving while intoxicated. One of those times was less than a month prior to this crash. If the punishment for DWIs was stricter could those Nebraska couples lives been spared? The punishment for the most DWI convictions in only a misdemeanor, it takes at least four convictions to be considered for a felony. DWI is an action that could lead to the death or injury of an unsuspecting person. Maybe because jail time is rare and the crime is not considered a serious felony, is why many people convicted of DWI are likely to re-offend.
