1) Is Diane's reaction to Larry's promotion justified? Why or why not?.
After analyzing the Briarwood case, it became clear that Diane's reaction to Larry's promotion was unjustified. She was solely considering her accomplishments and failed to realize that Larry, her co-worker who received the promotion, was also diligent and capable. Diane was certainly not being self-critical. There was no comprehension about the qualifications that were required to receive this promotion. Diane simply believed that because she had put forth a great deal of effort she automatically deserved the promotion. However, there were numerous other qualified candidates that had substantial experience at Briarwood on their resumes. The case stated that Diane was not even in the final round of consideration. This fact makes it obvious that she was not reflecting on her performances in the correct manner. Her vast experiences at Briarwood proved that she was committed and loyal to the company. Conversely, other candidates also proved to be dedicated employees. Diane did a great deal for Briarwood, but she did not put herself in an upfront position to be considered. Larry made it apparent that he was working towards receiving this promotion while Diane simply 'hinted' at the idea to her boss. .
2) Does Diane have legal grounds to sure the company?.
Upon further research on the subject of the legal obligations of a company in regard to promotion it was concluded that as long as Briarwood did not make their decision based on age, race, religion, sex, or disability then there is no legal recourse that can be taken. The company has the power to decide which employee receives the promotion. If Briarwood had the correct reasoning for giving Larry the promotion, Diane does not have a strong legal case to bring to court.
