Law Case Studies

6.) I do agree with the statement that the Supreme Court made because I feel that for the most part a lawyer does not try to make it difficult for the police to do their job, I feel that they just try to defend and caution their client as best as they have been taught. I can see how many people, especially police officers, may feel that the lawyers are there to cause problems, but really I feel that the problems they cause are the result of unfair questions or procedures that would otherwise take place without a lawyer present.
1.) I agree with the judge's ruling that a juvenile needs assistance at a hearing where he or she could be committed because with a juvenile it is much easier for police to intimidate one into giving an entire confession without knowing the rights given to them by the Constitution. I also agree that if the lawyer cannot be paid for, one should be provided. I feel that a juvenile case is as important as a murder trial, the child could be imprisoned in a detention center and without proper defense and information, the child could be found guilty and lose their childhood. It is a large issue to place children in detention centers for the remainder of their childhood years.
2.) I think that this recommendation is a good idea because it is my strong opinion that a child be given every form of defense available, even if it is not wanted by the child or the parents/guardians. The idea is to help the child as best as possible and to be fair, this idea of counsel seems like an incredibly fair one.
3.) I feel that any person should have the right to counsel as soon as they are arrested, not juveniles alone. If during the questioning process the suspect admits to something he or she would have been advised not to admit to, the rights of the suspect have been violated.
4.) This question is very situation based. If I committed a crime that in juvenile court I would receive a lesser sentence than if tried in adult court I would settle for the juvenile court.
