The U.S. has almost no law especially against cell phone use when driving. The only thing that people can be pulled over for using a cell phone is under the "reckless and inattentive driving" law, but it is hardly ever enforced. If this law were more diligently enforced, a lot less people would die or be injured from accidents involving cell phone use. .
The number of cell phone owners has climbed into the tens of millions. As a result, the user groups have shifted from primarily middle-aged businesspersons, to the young and elderly who use it for more personal reasons (www.nhtsa.dot.gov). The rapid increase of users is mainly due to the increasingly smaller size and growing capabilities. Cell phones have gone from something as large as a briefcase or a backpack to something that will fit into your back pocket. This makes them much more convenient and so they are used more. Today many families are replacing their home phones with cellular phones. It is not uncommon for sixth grade students to have their own cell phones. Obviously, they are very popular. .
Nine percent of all users are age twenty-four and younger. This is the age of the higher auto insurance. The insurance is raised on these drivers for a good reason. These drivers are still obsessed with speed. They do not need the added influence of a conversation going on while they are racing down the road, hoping that they don't get caught. As a member of this age group I am well aware of the need for fewer distractions when I am driving. .

There are several arguments against cell phone litigation. I will address some of them and show why they may not necessarily hold true. One argument is that cell phone laws would be an infringement on personal freedoms. A law against driving with a cell phone would not be infringing on a personal right because driving is not guaranteed to you, much less driving while talking on a cell phone.
