As a form of political communication, advertisement is used to link the voters and the politicians. Political advertisement has evolved in a greater measure capturing a wide area of the political campaign strategy (Middleton and Chamberlin 1988). Political promoting is considered to be consecrated in the United States. Truly, this type of publicizing was once in a while the subject of laws manages or court choices (Zuckman, Robert, Frieden & Kenedi, 1999). Furthermore for excellent reason of freedom of expression, condition of the First Amendment to the United States provides a confusing situation in its law implementation. Constitution provides that the congress cannot make laws that interfere with freedom of expression. In United States, political advertising is associated with commercial advertisements as a form of thought and candidate promotion. Depending on the form or the channel used to communicate the ideas of politicians, political advertisements are subject to very minimal degree of regulations.
The first amendments to the laws governing communication provide for a free press under the United States constitution. Therefore, there are no controls on the structure or content subjected to print media (Middleton & Chamberlin, 1988). However, broadcast media are subjected to complex regulatory system under the supervision of national Communication commission (FCC) that administers Federal communication act (FCA). Federal Communication law requires that there be equal time provision for all candidates and broadcast stations to sell their time at an affordable price for all politicians to have access to the services right to adverts. The adverts are also supposed to have with them the disclaimer indicating the sponsoring party. These requirements however have not been implemented by the supreme court of United States (Middleton & Chamberlin, 1988). Again with a few exceptions, Federal campaign rule does not apply to political ads over the internet that is to the effect that the federal laws only applies to the broadcast from which internet is excluded apart for the political party websites.
