Aboriginal Sentencing

 

The principles of sentencing apply to all offenders equally, and so in many situations such a remedy will not be appropriate to the circumstances of the case. (Justice Education, 2013).
             In the 1800's the Aboriginal children were forced to be in 'Residential schools' for 10 months out of the year, away from their families, due to the fact that Canada felt that it would be better to educate them, at a young age about the Canadian language, the country, and religion. In the time being, there was a lot of abuse that took place such as, physically, emotionally, and unfortunately sexually. When the Aboriginal children in the Residential schools returned to their reserve after the 10 months that they were there, the Aboriginal children felt out of place since they had been away from it for so long. The children lost the education of their own actual heritage; the language, the daily chores, and the rules were. (AADNC, 2013) Aboriginal children returning to their reserve from the Residential school made them feel unaccepted on the reserve due to their lack of education about the heritage, as well as Canada was not very welcoming to Aboriginals in general. As a result, this made the abandoned ideology surface to their emotions, feeling disenfranchised from society. Children to the parents that were in the residential school are sexually abused because the parents thought that it was okay to do, since it was done to them in the residential school. In 2009, close to 67,000 or 13% of all Aboriginal women aged 15 and older living in the provinces stated that they had been violently victimized. Overall, Aboriginal women reported experiencing close to 138,000 incidents of violence and were almost three times more likely than non-Aboriginal women to report having been a victim of a violent crime. This was true regardless if the violence occurred between strangers or acquaintances, or within a spousal relationship.
