Three Strikes

 

            Is the three strikes and you"re out law an advancement in the Criminal Justice System? Its an advancement to a certain extent but overall I don't believe that it is. I believe that the law has good intentions, yet it has several flaws. The law was established to make sentencing longer for offenders who are convicted of several felony's and for several different times. Yet I feel that its flaws still keep the law from becoming an affective law.
             The three strikes law is at times confusing and unclear about its terms and regulations. The government also doesn't really say when the law comes into affect, it just does when it needs to or when it has too. Any "violent" and or "serious" crime is counted as a strike unless it is amended by a "super majority", that's when the two thirds of the legislature votes for it. It is also suppose to specify if a sentence is done concurrently or consecutively, and it restricts the amount of time that a prisoner can have taken off his or her sentence. I think that its biggest flaw is that the law tends to put away people and give them strike after strike for things that don't seem to big of offenses. Things such as stealing are counted as strikes and have people getting put in prison for long periods of time, even though they might have just stole a pair of shorts. Also another thing that I believe is very unclear and some what of a flaw is what they consider a serious felony. Something's that people like you and I would consider a big deal or offense is not looked upon as bad or serious by the system as other minor things are. I also believe that the law is sometimes not justified and it comes to affect when it really doesn't have to.
             On the other hand there are positive arguments for the three strikes and your out law. The judicial system says that it sentences multiple offenders efficiently and justifiably. But I feel that at times people who commit serious crimes get off easily all the time and this doesn't help the system all.
